Syncrude Spring Tradeshow: Official Contest Rules

1. General

(a) By participating in this Contest, each participant unconditionally accepts and agrees to (a) the terms and conditions set out in these Official Rules, and (b) the decisions of Syncrude Canada Ltd. (“Syncrude”), with respect to all aspects of the Contest, which decisions will be final and binding. Syncrude is the sponsor of this Contest (the “Sponsor”).

(b) Sponsor, in its sole discretion, reserves the right to disqualify any person it finds to be in violation of the Official Rules.

2. Contest Period

The Contest starts at 9:00a.m Mountain Standard Time (“MST”) on April 26, 2019 and closes at 23:59 p.m. MST on April 28, 2019 (the “Contest Period”).

3. Entry

a) There is no purchase necessary to enter the Contest.

b) An eligible participant can enter by posting a photo taken at the Syncrude tradeshow booth on either Instagram or Twitter and applying the hashtag “#SyncrudeHerd”. The photo must be posted on the participant’s Instagram page and not their Instagram Story. The photo must be posted during the Contest Period and according to these Official Rules to be eligible.

c) Review of all Contest submissions is a manual process that will be conducted in Sponsor’s sole discretion, once the Contest Period has closed.

d) Sponsor will determine, in its sole discretion but acting reasonably, whether the post meets the requirements for entry and will be considered a valid entry. If plagiarism, ghostwriting, or an infringement of any other person’s rights by a participant has occurred or is suspected by Sponsor acting reasonably, the participant may, at Sponsor’s option, no longer be eligible for entry.

e) A valid entry consists of one post made on either Instagram or Twitter during the Contest Period. Participants who post a photo taken at the Syncrude tradeshow booth on either Instagram or Twitter and applying the hashtag “#SyncrudeHerd” during the Contest Period will be automatically entered, unless he or she expressly communicates to Sponsor his or her desire to not participate. Sponsor, in its sole discretion, will determine whether or not a submission meets the requirements for a valid entry.

By participating in the Contest, each Entrant hereby warrants and represents that his/her Submission (and each component thereof):

  1. does not violate any law, statute, ordinance or regulation;
  2. will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, or give rise to any claims whatsoever; and
  3. is not defamatory, trade libelous, pornographic or obscene, and further that it will not contain, depict, include, discuss or involve, without limitation, any of the following: nudity; alcohol/drug consumption or smoking; explicit or graphic sexual activity, or sexual innuendo; crude, vulgar or offensive language and/or symbols; derogatory characterizations of any ethnic, racial, sexual, religious or other groups; promotes harm against any group or individual; content that endorses, condones and/or discusses any illegal, inappropriate or risky behaviour or conduct; personal information of individuals, including, without limitation, names, telephone numbers and addresses (physical or electronic); and/or any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor in its sole and absolute discretion.

The Sponsor and/or its promotional agency or designated content moderator (the “Reviewer”) will initially screen every Submission.  Any Submission (or any component of a Submission) that the Reviewer deems, in its sole and absolute discretion, to violate the terms and conditions set forth in these Rules is subject to disqualification.  The Reviewer reserves the right, in its sole and absolute discretion at any time, to modify, edit or remove any Submission (or any component of a Submission), or to request an entrant to modify, edit and/or re-submit his or her Submission (or any component of a Submission), in order to ensure that the Submission complies with these Rules, or for any other reason. 

f) An entry will be disqualified if it (i) provides information that is incomplete or inaccurate, or (ii) fails to comply with or is determined to be or involve, in Sponsor’s sole discretion, an attempt to circumvent the terms and conditions of these Official Rules, or (iii) fails to comply with either Instagram’s terms and conditions and character limits, and/or Twitter’s terms and conditions and character limits, or (iv) fails to comply with terms and conditions which Sponsor has applied to its Instagram and Twitter pages.

g) Entries will be limited to one per participant, through posting either on Instagram or Twitter and applying the hashtag #SyncrudeHerd. There is no limit to the number of participants. If one participant posts multiple times or on both platforms, then such posts will be considered one entry.

h) Sponsor does not accept Contest entries by phone, fax, courier, or email, or Instagram and/or Twitter direct/private messages. If a participant, in Sponsor’s sole discretion, is found to be participating in an attempt to hijack or influence the Contest (for example, participating in collaboration with other parties) such participant will be ineligible, and such participant’s entries will be judged void.

4. Eligibility

To be eligible to participate in this Contest a participant must be:

(a) A legal resident of Alberta;

(b) At least eighteen (18) years of age at the time of entry;

(c) An individual (not a corporation, municipality, partnership, society, or other non-natural entity);

(d) In compliance with these Official Rules including but not limited to the specific requirements of section 3 hereof; and

(e) Have an active Instagram and/or Twitter profile. If you do not have a Instagram account, visit and/or and register in accordance with the enrolment instructions for a free Instagram and/or Twitter account. 

Employees of the Sponsor and its affiliates, subsidiaries, or related companies and the household members of any of the above, are eligible to participate in the Contest.

The Sponsor shall have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to the Sponsors for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. The Sponsor reserves the right, in their sole discretion to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate, misleading personal details and/or information.

5. Prize

(a) Sponsor will award one (1) prize (the “Prize) available to be won by the Prize winner (the “Winner”) consisting of a MacDonald Island Park 10-Pass Family Card package.

(b) The Prize has an approximate value of one thousand dollars (CDN $1000).

(c) Odds of winning depend on the number of eligible entries.

(d) The Prize will be administered only by Sponsor in accordance with these Official Rules, and where these Official Rules are deficient, ambiguous, vague, or contradictory, Sponsor will determine such matter in its own discretion. If, in the sole opinion of Sponsor, the Prize may not be granted for an unexpected reason or some reason outside the control of Sponsor, Sponsor will have the right, but not the obligation, to substitute the Prize with something else which may differ in value to the Prize.

(e) The Prize must be accepted as offered in these Official Rules, or will otherwise be forfeited by the Winner. If forfeited, Sponsor will not be required to compensate the Winner in any other way, and will in no way be liable to the Winner. If the Prize is forfeited by a selected participant, Sponsor will re-select a Winner in the same manner the first entry was selected, and so on in the event of forfeit until a participant accepts the Prize.

6. Prize Winner

One Winner will be selected as follows:

(a)Sponsor will endeavour to select the Winner within seven (7) business days of the end of the Contest Period, however, the volume of entries, and potential difficulty in contacting a Winner, may delay the selection. Selection will be by random selection using a random number generator computer program that will pull from all eligible entries.

(b) Once selected, Sponsor will contact the participant identified and associated with the selected entry by a direct (private) Instagram or Twitter message.  By entering this contest, you are hereby consenting to Sponsor sending you direct messages to your Instagram and/or Twitter account.   Only three attempts will be made, over a three-day period, with the first attempt made immediately after the selection is made. If direct contact is not made with the selected participant for any reason within seventy-two (72) hours of the first attempt, if the selected participant is contacted but Sponsor is subsequently unable to re-contact the selected participant to complete Prize administration, or if the selected participant is unwilling or unable to comply with these Official Rules, all in Sponsor’s opinion and discretion, he or she will thereby forfeit the Prize with no further recourse against Sponsor, and another participant's entry will be selected in the same manner the first entry was selected, and so on until a winner is contacted.

(c) Once contacted, the selected participant will be required to answer a skill testing question that will be administered on the phone.  If the correct answer is provided the selected participant will be asked to provide his or her mailing address and other details pertaining to the contest and the Prize. Details include but are not limited to, shipping instructions, delivery details, contact information, eligibility validation (including birthdate), and general questions including, without limitation size information. Sponsor may require the selected participant to engage in a telephone conversation through which the selected participant will be asked for such information. Each participant represents and agrees that he or she will provide accurate and truthful information to Sponsor, and agrees that Sponsor may use means it deems necessary to confirm information provided.

(d) Upon Sponsor’s verification that the selected participant is in compliance with all of the Official Rules, the selected participant will be declared a Winner. If, for any reason, the selected participant is in breach of these Official Rules or is ineligible, the selected participant will not be entitled to the Prize.

(e) The Prize will be mailed to the Winner’s home address. Sponsor will mail the Prize within a reasonable time after the Winner is determined, but does not guarantee any timeframe in which the Prize will be delivered. Sponsor will not be responsible for delays or errors in postage.

(f) The Winner may be announced on the Sponsor Instagram and/or Twitter page(s).

(g) The Winner may refuse the Prize, in which case Sponsor will not be required to award the Prize to that Winner.

7. Liability Limitation

The Sponsor assumes no responsibility or liability for lost, late, unintelligible/illegible, falsified, damaged, misdirected or incomplete entries, notifications, responses, replies, or for any computer, online, software, telephone, hardware or technical malfunctions that may occur, including but not limited to malfunctions that may affect the transmission or non-transmission of an entry. The Sponsor is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the administration of the Contest. The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, e-mail, players, or browsers,on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoingor otherwise. The Sponsor is not responsible for any injury or damage to entrant or to any computer related to or resulting from participating or downloading materials in this Contest. Entrant assumes liability for injuries caused or claimed to be caused by participating in the Contest, or by the acceptance, possession, use of, or failure to receive any Prize. The Sponsor assumes no responsibility or liability in the event that the Contest cannot be conducted as planned for any reason, including those reasons beyond the control of the Sponsor, such as infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or corruption of the administration, security, fairness, integrity or proper conduct of this Contest and/or the Contest website.

8. Indemnity

By entering the Contest, entrant releases and holds harmless Sponsor, Instagram, Twitter and their respective parent companies, subsidiaries, affiliates and/or related companies and each of their employees, directors, officers, suppliers, agents, sponsors, administrators, licensees, representatives, advertising, media buying and promotional agencies (collectively, the “Releasees”) harmless from any and all claims, demands and liability for any injury, loss or damage of any kind to any person or persons, including death, property damage, and the infringement of any intellectual property rights, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any Prize, participation in the Contest, any breach of the Official Rules, or in any Prize-related activity. The entrant agrees to fully indemnify Releasees from any and all claims by third parties relating to the Contest, without limitation.

9. Disclaimer of Warranty

Except as otherwise set out in these Official Rules, Sponsor makes no warranty, guarantee or representation of any kind concerning the Prize and disclaims any implied warranty. Sponsor will not be responsible for the inability to use the Prize or any vendor to accept the Prize. However, in the event the Prize is defective or does not meet the value as represented, then the Sponsor will re-issue the same or similar Prize of a value which was unable to be used by the Winner. In such case, Sponsor will require confirmation, to Sponsor’s sole satisfaction, that the Prize was otherwise unused, of the defectiveness or value discrepancy directly from the MacDonald Island Park, or other evidence deemed relevant by Sponsor, as the case may be.

10. Publicity

Except where prohibited by law or regulation, by submitting an entry and accepting the Prize, the Winner grants Sponsor (and its nominees) a perpetual, worldwide, royalty-free license to use his/her name, photograph, video, voice, likeness and the whole or any part of any statement or statements he/she has made or makes concerning the Contest or the Prize, for Sponsor (and its nominees) to use in connection with any publicity, promotion or advertising of any nature, whether or not related to the Prize or Contest and the participant hereby consents to such use without further notice, consent, approval or compensation. Each Winner agrees to make him or herself reasonably available for an opportunity to have photographs taken of him or her. Each Winner also agrees that Sponsor may publish his or her name, city and province of residence as being the Winner of the Contest.

11. Taxes

The Winner is responsible for reporting any taxable benefits in connection with the Contest to all applicable governmental authorities. Any taxes relating to the acceptance or use of the Prize are the sole responsibility of the Winner.

12. Changes to the Contest

Sponsor reserves the right to change the terms of this Contest and these Official Rules, and suspend or cancel it, at any time, for any reason, without liability on the part of Sponsor, and without prior notice.

13. Entries

All entries become the property of Sponsor. The receipt of any entry will not be acknowledged and no entry will be returned. Each participant represents that he or she owns or has rights to all intellectual property in any Contest entry material, and any and all such intellectual property rights associated with any entry, including copyright, patent, or trademark, including moral rights, are, upon submission of the entry by a participant, transferred and assigned to Sponsor.

14. Termination

Sponsor reserves the right, in its sole discretion, to terminate the Contest, in whole or in part, and/or modify, amend or suspend the Contest, and/or the Official Rules in any way, at any time, or any reason without prior notice.

15. Governing Law

A prospective participant may not participate in the Contest where it is prohibited. The interpretation of these Official Rules and all matters relating to the rights and obligations as between any participant and Sponsor in connection with the Contest shall be governed by, construed and interpreted in accordance with the laws of Alberta, without giving effect to any choice of law or conflict of laws rules or provisions. Sponsor and all participants hereby agree to attorn to the jurisdiction of the courts of Alberta, sitting in the City of Edmonton (and all courts of appeal therefrom), in respect of the determination of any matter, issue or dispute arising in relation to these Official Rules, the Contest or the acceptance or use of the Prize and agree that any such determination shall be sought solely and exclusively before such courts.

16. Discrepancy with Other Material

If there is a discrepancy or inconsistency between the terms and conditions of these Official Rules and any other material relating to the Contest, these Official Rules shall prevail, govern and control. In the case of a discrepancy or inconsistency between these Official Rules and any Declaration Consent and Release Form which may be used for this Contest, both will apply to the extent possible, but these Official Rules shall prevail, govern and control.

17. Third Party Trademarks

The names of any individual, group, company, product or service mentioned herein or on the Contest website, and any corresponding likeness, logo or image thereof, have been used for identification purposes only and may be the copyrighted properties and trademark of their respective owners. The mention of any individual, group, company or sponsor, or the inclusion of a product or service as a Prize or on the Contest website, does not imply any association with or endorsement of such individual, group, company or sponsor or the manufacturer or distributor of such product or service or the product or service itself and, except as otherwise indicated, no association or endorsement is intended or should be inferred and Sponsor makes no representation or warranty about them and specifically disclaims any which may otherwise arise under law.The Contest is in no way sponsored, endorsed or administered by, or associated with Instagram and/or Twitter.  You understand that you are providing your information to Sponsor and not to Instagram and/or Twitter. Any information Sponsor’s privacy policy. Instagram and/or Twitter are completely released of all liability by each entrant in this Contest.  Any questions, comments or complaints regarding the Contest must be directed to Sponsor and not Instagram and/or Twitter.

These Official Rules are effective as of 9:00 a.m. MST on April 26, 2019.
